PROVISIONS ON THE TRANSIT, FREIGHT TRANSIT AND CONSUMER GOODS IN TRANSIT BETWEEN VIETNAM AND CAMBODIA
This Circular replaces Circular No. 08/2009 / TT-BCT dated May 11, 2009 by the Minister of Industry and Trade provides for the transit of goods through the territory of the Kingdom of Cambodia, Republic of Vietnam Socialist . This Circular applies to agencies, organizations and individuals involved in activities related to the transit of goods under the provisions of the transit agreement between the Government of the Socialist Republic of Vietnam Royal Government of Cambodia and December 26, 2013
Accordingly, the means of transport of Vietnam, Cambodia or third countries involved in the transport of goods in transit by road, waterways specified in Article 10 of the Agreement must comply Trucking Agreement signed between government of the Socialist Republic of Vietnam and the Royal government of Cambodia, June 1, 1998, the Agreement signed between the government of the Socialist Republic of Vietnam and the Royal government of Cambodia on trucking shui December 17, 2009, the guidelines, modify, supplement or replace these documents and other legal provisions involved.
Procedures for entry and exit means of transport and escorts; procedures for storage, warehousing of goods in transit; procedures, shifting, changing transportation of transit goods shall comply with the provisions of the Customs Law and the documents guiding the implementation of the Customs Law.
Shippers or carriers must be submitted and presented the vouchers to the customs authorities under the provisions of the customs legislation and guidelines. Goods in transit are allowed to stay in the territory of Vietnam in a maximum period of 30 (thirty) days from the date of completion of customs formalities at the border importation, unless the time is extended too scene as prescribed in Article 11 of this Circular. The extension of the period of transit of goods by the licensing authority to consider and settle for goods in transit under the license and by the customs authorities to consider settling for goods in transit are not prescribed under license under the law.
The change of gate exports and imports within the provisions in the Agreement by the licensing authority to consider and settle for goods in transit under the license and by the customs authorities to consider settling for goods transit not under license.
Shippers, carriers perform transit operations through the territory of the Socialist Republic of Vietnam have the rights and obligations stipulated in the Agreement, this Circular and other legal documents involve.
This Circular takes effect as from October 20, 2014.
